The Learncafe user, whether student or author, duly identified upon registering on the website www.learncafe.com, for all purposes that may be necessary, declares to have knowledge and agrees to adhere to the terms specified below, and must comply with all provisions that are part of this EDUCATIONAL SERVICES PROVISION CONTRACT that will be entered into between Learncafe and the user registered as a student enrolled in any of the courses, as well as the authors of said courses, at the time of their acceptance. A student is considered any user registered on Learncafe who acquires and effectively takes one of the courses offered, whether free or not. An author is considered any user registered on Learncafe who makes a course available to interested parties, being entirely, unrestrictedly, and exclusively responsible for the authorship, veracity of information, content, compliance with national legislation, especially the Copyright Law, and other considerations pertinent to the course made available.
To students and interested parties:
- Support for the course content (tutoring) by the teacher is not mandatory, but when offered, it must be provided solely and exclusively by the respective teacher, who is also responsible for making available the communication options, such as email, messaging, communicators, telephone, and/or others.
- When the course is not free, the student must make the enrollment payment under penalty of restriction to access the course content.
- Learncafe will never charge the student additional fees, monthly payments, or any other amounts for enrollment in already paid courses without prior communication and authorization.
- Enrollment in free courses is exempt from hidden fees or monthly payments. If Learncafe offers any additional paid service, it will be optional, and it will be up to the student to pay or not for the use of the service, without any obligation.
- The student will not pay any other amount beyond that provided for the enrollment fee, which allows the student online access to the entire desired course until the expiration date, as per the information implemented by the teacher.
- Access to free courses made available by Learncafe is done through sharing on social networks Facebook or Twitter, or through sharing by email to their contact list (Gmail, Yahoo, Outlook, or Hotmail). The user understands that access to the profile and contact list is necessary to perform the sharing, requiring authorization for access to their account so that Learncafe can send the invitations on their behalf, always duly identified (or on behalf of Learncafe itself).
- At the end of the course, the student may acquire the electronic certificate in PDF with location code issued by Learncafe (which will prove the completion of the course by the student) ONLY IF our pedagogical proposal is fulfilled. The digital certificate will only be made available for download after calculation of a maximum of 12 hours of daily study on the total workload of the course, AND has completed a minimum of 20% of this same workload informed, complying with the deadlines and limits for certificate issuance.
- The completion certificates issued by the student for the courses taken on our platform have a validity period of 1 (one) year from the date of completion and conclusion of the course. Thus, after 12 months, the certificate will receive the status "expired" and will no longer be valid, and the student must refrain from using it.
- The enrollment fee for courses does not include the issuance of certificates, and it is necessary to purchase the certificates separately. Thus, the student who completes a course and wishes to obtain the completion certificate (digital or printed) must perform the purchase procedure for subsequent issuance.

Digital certificates and printed certificates are distinct products and services from each other, so the acquisition of one does not entitle to the other, and it is necessary to acquire separately digital or printed certificates.
- Learncafe does not allow the student to conduct simultaneous studies of one, two, or more courses in which they are enrolled. This means that the student must keep only one browser tab open in content to be studied. This fact is important so that the proper accounting of study hours occurs; otherwise, the student will be automatically prevented from continuing the studies if more than one tab open in lessons is detected.
- The offered digital certificate is not sent via mail, is not printed by Learncafe, and does not have a signature with notary authentication or acknowledgment of signature; it is a document made available digitally for printing by the student themselves, upon separate purchase of the course enrollment fee value.
- The student must use the forums, glossaries, and other resources made available by Learncafe for exclusively didactic purposes, aimed at their training and utilization, without using spam, offensive language, or making reference to matters unrelated to the course objectives, under penalty of being fully and exclusively responsible for any judicial or extrajudicial measures that may be taken regarding their publications.
- It is expressly forbidden for the student to save, copy, print, or disclose the content of the courses in which they are enrolled, or pass them on to third parties, except with express written permission from the teacher/author responsible for the course or within the limits permitted by law.
- The student declares to know the terms of the current copyright legislation and further informs that they will not use, reproduce, or disclose any intellectual or copyright material belonging to third parties, under penalty of being exclusively and fully responsible, under the terms of Brazilian legislation, for any violation of copyright and judicial and/or extrajudicial actions arising from these violations, brought by anyone, including but not limited to possible authors, publishers, and other interested parties.
- All course content is the exclusive and full property and responsibility of the teacher/author, so any doubts the student may have must be directed to the teacher/author of the course, who may, if they have the conditions, respond directly to the student through the mechanisms made available on the Learncafe website. We emphasize that tutoring, by the teacher, is not included in the course value, being an optional and non-mandatory feature of each author.
- The student must treat the teacher and all other participants on the Learncafe website respectfully and cordially.
- The fee charged for enrollment in non-free courses does not imply responsibilities for consulting, support, or any other interference by Learncafe, and any act that requires contact with the teacher (course author) is optional and up to the teacher (course author) exclusively, and Learncafe is not responsible for cases in which the teacher does not return contact or where it is made without the student's satisfaction.
- Learncafe users may not publish low-caliber words and offensive content to third parties, as well as racist, immoral, illegal, defamatory content, offensive to good morals, and others of the like, under penalty of account cancellation and other measures that the offended party may take, and there is no responsibility of Learncafe regarding the published content.
- Learncafe users must, obligatorily, maintain their own profile through registration on Learncafe, committing and taking responsibility for the veracity of the information contained therein, under penalty of suffering the applicable legal sanctions. Learncafe reserves the right to alter information filled by the user whenever it deems necessary to correct or delete fields filled incorrectly or falsely.
- Learncafe is not an entertainment portal; it is an online channel for providing educational services aimed exclusively at the education and enhancement of knowledge of its users.
- Learncafe reserves the right to suspend and/or exclude users, courses, certificates, students, and teachers without prior notice, in case of non-compliance with the rules established here or with current legislation, and no payment of indemnities, reimbursements, and damages is due to any of the infringing parties.
- The student is not authorized to conduct financial transactions, make chargebacks, or donations to any other Learncafe users, including teachers, students, or other user profiles.
- Learncafe is not responsible for the content of messages published by users, who are solely and exclusively responsible for what they publish in the various communication vehicles offered, such as message wall, forum, chat, doubts, evaluations, and others, responding fully and exclusively for any judicial or extrajudicial measures that may be taken regarding their publications. However, Learncafe may delete or edit messages that present incorrect or false information.
- The user understands that Learncafe pages are accessible through search engines, which may locate pages with user names and/or published courses; the removal of personal data and other user information must be requested directly from the web services made available, and it is not Learncafe's responsibility to take any measures in this regard.
- The user understands and authorizes the publication of comments and evaluations made by them regarding the courses taken.
- The courses published on Learncafe have an access period; it will not be possible to complete the studies after the deadline expires. After the access period to the lessons expires, it will be necessary to renew enrollment, paying a new enrollment fee.
- The student understands and accepts that Learncafe is a portal of free courses only, and there are no courses with diplomas at technical, undergraduate, bachelor's, teaching, postgraduate, master's, or doctoral levels, even if they are mentioned in their titles or descriptions.
- The course title and other pertinent information are the sole and exclusive responsibility of the teacher/author of the course, responsible for feeding the site and making the content available.
- Learncafe reserves the right to rename courses and descriptions at any time, without prior notice, as well as other course metadata.
- The student understands that the workload (course duration) when manually filled by the teacher may not correspond to the offered content; in these cases, the student commits to contacting the COURSE TEACHER/AUTHOR. The student also commits not to use the certificate of said course under any circumstances, knowing that when the duration or other pertinent information to the course does not reflect the reality of the offered content, the certificate becomes untrue/invalid.
- The student must also, when the workload (course duration) manually filled by the teacher/author does not correspond to the offered content, contact Learncafe for the necessary measures, including but not limited to warning the teacher/author for the proper correction of the workload. If the warning is not heeded by the teacher/author, Learncafe may suspend/exclude the course that presents such incompatibility, as the case may be, and no payment of indemnities, reimbursements, and damages is due to the teacher/author.
- In case of discrepancy between the content informed by the teacher/author and the content actually published, the student may request the return of the amounts invested by them in the provision of the contracted educational services, a request that will be analyzed by Learncafe and subsequently refunded or not, as the case may be. Recognizing the possibility of refund, Learncafe will contact the student to collect bank details and information that may be necessary.
- The student understands that courses with excessive workload may undergo changes in the course duration informed by the teacher/author, without prior notice.
- The student understands that they may take only one course at a time, and it is not permitted for the student to take two or more courses simultaneously. The student may enroll and start more than one course at a time, but may only account for study hours in a single lesson of a single course at a time, simultaneous accounting not being permitted. This measure is necessary so that the student makes better use of their studies, aiming to ensure the quality of our services and to the maximum extent guarantee the validity of our certificates.
- The student understands that they may only take one free course at a time, with a current grace period of 120 days so that they can take another free course. The grace period for taking new free courses may vary to more or fewer days, without prior notice.
- The student understands that the free courses made available from the "Learncafe Youtube Courses" profile are registered by our internal team from Youtube playlists that have an embedding option, where we reference access links to the channel and all copyrights. We make the content available free of charge, as a title of knowledge dissemination. Thus, the student also understands that this free content may be taken offline at any time, without guarantees or rights to the student(s).
- The digital completion certificate in PDF will be available for download for two months after the course completion. After this period, Learncafe will not be able to provide new copies of certificates (already issued or not).
- Users must also, at their own expense and risk, have all the equipment and software necessary for internet access, in addition to applications, plugins, and extensions necessary for viewing content in its various formats, such as the Adobe Flash Player and Adobe Reader plugins, as well as having a permanent and valid email address for contact with Learncafe. It is the exclusive responsibility of the user to keep Learncafe's database updated, and Learncafe will not be responsible for incorrect filling or providing imprecise or wrong information, and it is not Learncafe's responsibility to take any measures to collect or search for new registration data. Also, no payment of indemnities, reimbursements, and damages will be due.
- The access password to Learncafe is the exclusive choice and responsibility of the user, and it is recommended not to use the same password in other environments, applications, or internet sites. This is an important security measure so that the user does not have data leaks from third-party sources.
- The student understands that, in case of profile deletion on our platform, the certificates of the courses taken will be automatically invalidated. They also understand that, in case of course deactivation, by deleting it from their profile, the certificate will be equally invalidated.
- Starting in September 2015, Learncafe makes available requests for printing certificates. The student is hereby aware that this service has an additional fee (optional) for production and delivery, not included in the course enrollment value. Printed certificates are optional and may be acquired respecting the delivery deadlines of the Post Office and deadlines for production and payment confirmation.
- In case of dissatisfaction with the content made available in the course, the student may request their money back if they have not gone through more than 40% of the course content, and have made the refund request within a maximum period of 7 days from the enrollment date in the course.
- The refund will not be allowed in cases where the student has completed (concluded) the course.
- The refund will not be possible in cases where the student has issued or downloaded the completion certificate.
- In accordance with item 31 of this document, the student understands that contact with Learncafe will be made exclusively through email address (email), with [email protected] or our contact form being the forms made available for support. Our social networks such as Facebook, Twitter, Instagram, Blog, and others are not proper means for providing support and therefore cannot be used for this. Our support operates from Monday to Friday, from 09:00 to 18:00, except on holidays and extended holidays, and our response deadline is 24 business hours from the time of receipt of the request.
- The user understands that Learncafe servers are configured with Greenwich Mean Time (GMT), which means that some date and time information will show a difference of UTC-3:00 in relation to Brasília time; however, the timezone configuration does not imply any prejudice in the assessment of facts, access deadlines, or expiration. - In September 2017, Learncafe began its internationalization process, making the platform available in other languages, countries, and currencies. Regarding this, even if the values of courses in Brazilian Portuguese are displayed in other currencies (for example: dollar, euro, pound, or peso), the payment methods will charge based on the value in real (BRL).
- On November 21, 2018, we began offering our students subscription plans, providing them with the option of monthly or annual recurring payment for access to all courses available in a given plan.

Access to the content of courses whose enrollment was made through some subscription plan will be guaranteed while the subscription recurrence period lasts; however, in case of default, access to these courses will be suspended - regardless of the expiration period - until the amount for the open period is settled.

While the student's subscription is active, they will have full access to the courses belonging to the chosen plan. To check the courses belonging to a given plan, visit the plan page and request to list all courses available in it.

A plan subscription may be canceled at any time, provided that the Consumer Defense Code (CDC) is respected. In addition, the refund (or chargeback) request must be made within 7 calendar days, which also requires that no course has been completed within that period.

"Cancellation of a plan" is understood as the suspension of future monthly or annual recurring charges for the use of that plan. Whenever the student requests a cancellation, we will attend to the request until the end of the current billing period, therefore, without new charges to be made for that plan.

Each subscription plan has its own listing of courses, to which the subscribing student will have access. Access to courses not registered in the respective plan will not be allowed. If the student is interested in other courses not included in the chosen plan, they will have to make individual enrollment or subscribe to another plan. Starting in January 2020, Learncafe makes available requests for purchasing digital certificates. The student is hereby aware that this service has an additional fee (optional) for obtaining certificates for completed courses, not included in the course enrollment value. Digital certificates are optional and may be acquired respecting the pedagogical conditions, terms and conditions, and payment confirmation.

Learncafe guarantees the issuance of the certificate within 30 days after course completion. This means that, although the certificate issuance is possible immediately after completing the studies, the student understands that the deadlines and commitments to which they will present the certificate will be at their own expense and risk, even if any technical difficulty or accessibility occurs for the certificate issuance on our platform. Responsibility should not be attributed to Learncafe regarding the uses and obligations that the student intends to make for the use of the certificate.

Before enrolling and using our certificates, one must consult the regulations of each selection process, contest, or interview to ensure that certificates issued by Learncafe will be accepted. Each institution has its own rules regarding the acceptance and use of completion certificates in free courses, and Learncafe is not responsible for any refusals or internal procedures of third parties.
The parties elect the forum of the District of Belo Horizonte, State of Minas Gerais, as competent to settle any controversies arising from these Terms of Use, regardless of any other, no matter how privileged it may be or become.
